Laws Prohibit Same Gender Sexual Harassment in the Workplace
Same-sex harassment violates New York state and federal laws. In Oncale v. Sundower, the Supreme Court held that Title VII of the Civil Rights Act prohibits same sex harassment. An individual therefore has the right to bring a claim for workplace harassment when the perpetrator and victim are of the same sex. In this case, the victim was subjected to humiliating sex-related actions and even threatened with rape. Supervisors took no remedial action. In fact, one superior exposed his penis and placed it on the victim’s body. Co-workers also attacked the victim in the shower and sodomized him with a bar of soap. The Supreme Court found that the Title VII prohibition against sexual harassment includes same-sex claims as well as those that condition liability on the same-sex harasser being gay or lesbian.
