Workplace Discrimination
In New York City, employment discrimination occurs when an employer treats an employee adversely based on a characteristic protected under federal, state, or local laws.
Many federal antidiscrimination laws are enforced by the Equal Employment Opportunity Commission (EEOC). These include Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), and the Age Discrimination in Employment Act (ADEA). However, these federal laws apply to midsize or larger companies.
If you work for a smaller company and are subject to workplace discrimination, harassment or retaliation, you may find relief under the New York State Human Rights Law or the New York City Human Rights Law.
Characteristics that are protected under the city law, widely regarded as one of the most liberal anti-discrimination laws in the country include:
- Age
- Arrest or conviction record
- Caregiver status
- Color
- Credit history
- Disability
- Gender identity
- Gender
- Sexual orientation
- Immigration status
- National origin
- Race
- Religion
- Military service
- Marital or partnership status
- Sexual and reproductive health decisions
- Status as a domestic violence, stalking or sexual violence victim
- Salary history
- Unemployment status.
Certain characteristics are also protected with regard to housing and public accommodations, among other things.
