Employment Discrimination and Harassment
The New York State Human Rights Law and the New York City Human Rights Law prohibit workplace discrimination, harassment and retaliation based on protected traits. The city law has a more expansive list of traits. Generally, if you work for a smaller company, you receive more protection under the state and city laws than you do under federal law. You are protected against sexual harassment even if you are the only employee of your employer.
Whether a sexual assault took place in the workplace or not, if you are a survivor of sexual assault based on your gender, you may be able to pursue damages under the New York City Victims of Gender-Motivated Violence Protection Law. A recent amendment to the law opened the statute of limitations for a two-year window so that survivors can sue for abuse that happened at any earlier point in time.
